By accessing and using NicheNest, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

NicheNest is a platform that connects people who want to host unique experiences ("Hosts") with people looking to book and attend these experiences ("Guests"). We facilitate the discovery, booking, and payment for local experiences, workshops, and activities.

3. User Accounts

To use certain features of our service, you must create an account and provide accurate information.

You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Providing accurate and current information
Notifying us of any unauthorized use of your account

4. Host Responsibilities

If you host experiences on our platform, you agree to:

Provide accurate descriptions of your experiences
Deliver experiences as described
Maintain appropriate insurance and safety measures
Comply with all applicable laws and regulations
Treat guests with respect and professionalism
Honor confirmed bookings or provide appropriate notice for cancellations

5. Guest Responsibilities

As a guest, you agree to:

Arrive on time and prepared for experiences
Follow host instructions and safety guidelines
Treat hosts and other guests with respect
Pay for bookings as agreed

6. Payments and Fees

Our Transparent Fee Structure:

NicheNest charges a simple 5% platform fee on each booking. We absorb all payment processing fees from our platform fee - no hidden costs, no monthly fees, no processing markups passed to hosts.

The current fee structure is:

5% platform fee deducted from host earnings - covers all services including payment processing, platform maintenance, customer support, marketing, and trust & safety measures
Payment processing fees absorbed by platform - we pay Stripe's 2.9% + $0.30 per transaction from our 5% fee, not from host earnings
Zero additional fees - no setup fees, monthly fees, listing fees, or hidden charges
Complete transparency - all fees are clearly disclosed before booking confirmation
Host keeps 95% of every booking amount, regardless of payment processing costs

Payments are processed securely through Stripe. We do not store your payment information. Hosts receive payouts within 24-48 hours after experience completion, with the option to request instant payouts.

Why 5%? Unlike other platforms that charge 15-20% plus hidden fees, we believe in sustainable, fair pricing. Our 5% covers our actual costs while leaving hosts with the vast majority of their earnings. We succeed when you succeed.

7. Cancellation Policy

Cancellation policies are set by individual hosts and clearly displayed before booking. We encourage flexible policies but respect hosts' right to set their own terms. Refunds are processed according to the applicable cancellation policy.

8. Prohibited Uses

You may not use our platform to:

Violate any local, state, national, or international law
Host or promote illegal activities
Discriminate against others based on protected characteristics
Harass, abuse, or harm others
Attempt to circumvent our fee structure
Post false, misleading, or fraudulent content
Interfere with the operation of the platform

9. Liability and Insurance

NicheNest is a platform that connects hosts and guests. We are not responsible for the actual experiences, safety, quality, or legality of hosted activities. Hosts are responsible for obtaining appropriate insurance and ensuring their experiences comply with all applicable laws and safety requirements.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the platform.

11. Modifications

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of new terms.

12. Termination
